
Arguably no industries have been more negatively impacted from Covid than lodging and food services. Congress recognized this and any business with North American Industry Classification System (NAICS) code that begins with 72 can apply for loans that are 3.5x average monthly payroll costs (compared to 2.5x with most businesses).Hopefully, the 3.5x average monthly costs PPP loans will allow the nation’s hotels and restaurants to start to recover financially and retain staff.
Here are some important rules related to hotels and restaurants and other food industry businesses to keep in mind for those applying for Second Draw PPP loans:
- Employs no more than 300 employees per physical location if NAICS Code 72 (accommodation and food services).
- Realized a reduction in gross receipts (aka revenues) in excess of 25% relative to the relevant comparison time period.
- Was in operation on February 15, 2020 and has not permanently closed.

Establishments primarily engaged in (1) preparing and/or serving a specialty snack, such as ice cream, frozen yogurt, cookies, or popcorn or (2) serving nonalcoholic beverages, such as coffee, juices, or sodas for consumption on or near the premises such as beverage bars, ice cream parlors, and on-premises banking businesses such as bagel, cookie, donut,and pretzel shops.

Establishments primarily engaged in providing food services at institutional, governmental, commercial, or industrial locations of others based on contractual arrangements with these type of organizations for a specified period of time such as airline food services contractors, cafeteria food services contractors (i.e., at schools, hospitals, government offices), and food concession contractors (i.e., at sporting, entertainment, convention facilities)

This industry comprises establishments primarily engaged in providing single event-based food services. These establishments generally have equipment and vehicles to transport meals and snacks to events and/or prepare food at an off-premise site. Banquet halls with catering staff are included in this industry.
